ZAIRYUU HEADLINER TERMS
Zairyuu Headliner (formerly Tokutei Ginou Headliner) Terms of Use
These Terms of Use (the "Terms") set out the conditions for using "Zairyuu Headliner" (the "Service"), a job advertising platform for foreign residents in Japan provided by Headliner合同会社 (the "Company"). A user (a "Job Seeker") is deemed to have agreed to these Terms upon browsing the Service, applying through it, making an enquiry or otherwise using it.
Article 1 (Definitions)
"Service" means the posting of job information for foreign residents in Japan, the guidance on how to apply, and the related information services that the Company provides.
"Job Seeker" means any individual who uses the Service.
"Use" means browsing all or part of the information on the Service, checking a Hiring Company's information at a linked destination, and any act of enquiry, application or the like.
Article 2 (Contents of the Service)
The Service is an information service that provides job information, application methods and similar content through the website, social media, video posting services and other media operated by the Company.
The Service is intended to provide information. The Company does not carry out employment placement, brokerage, or representation in legal procedures.
The Company is not a party to, and bears no liability whatsoever for, any contract or employment relationship formed between a Job Seeker and a Hiring Company.
Article 3 (Application, Amendment and Notice)
These Terms apply to all use of the Service by Job Seekers.
The Company may amend these Terms where there is a reasonable need to do so, and the amendment takes effect upon being posted on the Company's website or within the Service.
Notices from the Company are given through the Company's website, its official social media accounts, email or any other method the Company deems appropriate, and are deemed to have been received at the time of publication or dispatch.
Article 4 (Usage Environment)
Job Seekers shall, at their own cost and responsibility, prepare the environment necessary for use, including communication devices, communication lines and applications.
Article 5 (Accuracy of Information and Duty to Confirm)
The Company does not warrant the accuracy, legality, currency or usefulness of the information posted.
Job Seekers shall confirm for themselves the working conditions, status of residence requirements, remuneration, place of work and similar matters before applying.
The Company bears no responsibility beyond the scope of providing information, and bears no liability whatsoever regarding the formation, contents or performance of an employment contract.
Article 6 (Prohibited Conduct)
Job Seekers shall not engage in the following conduct.
Conduct that violates laws and regulations (including the Immigration Control Act and labour-related legislation) or public order and morals
Sending false or misleading information, or impersonation
Discrimination, defamation, or infringement of privacy, portrait rights or intellectual property rights
Harmful conduct such as viruses or spam, or obstruction of operations
Unauthorised reproduction, copying or redistribution of information obtained through the Service, or its reuse for commercial purposes
Cooperating in wrongdoing by a Hiring Company (such as concealing the fact of a hiring, or posting false job listings)
Involvement with organised crime groups or similar entities
Any other inappropriate conduct equivalent to the foregoing
Article 7 (Rights in Content)
Rights in the video, images, text and other material provided through the Service belong to the Company or to the rightful rights holder. Job Seekers shall not use such material beyond the scope of private use.
Article 8 (Deletion of Information and Suspension of Use)
Where the Company determines that a Job Seeker's conduct or postings breach these Terms, or that there is a risk of infringement of rights or of wrongdoing, the Company may delete them, restrict use or take any other necessary measure without prior notice.
Article 9 (Use of Logs and Similar Data)
The Company may collect and analyse usage data such as browsing history, application history and enquiry history for purposes including improving the Service and preventing misuse. Personal information is handled in accordance with the following article and the Company's Privacy Policy.
Article 10 (Personal Information)
The Company handles personal information obtained through enquiries, applications and the like appropriately in accordance with its Privacy Policy.
Where an application or enquiry is made through a Hiring Company's own form or similar means, that company's privacy policy applies.
Article 11 (Change, Suspension and Termination of the Service)
The Company may change the contents of the Service, suspend it temporarily or terminate it without prior notice for maintenance, failures, circumstances affecting external services, compliance with laws and regulations, or other unavoidable reasons.
Article 12 (Disclaimer)
The Company bears no liability whatsoever in relation to the use or inability to use the Service, or to any transaction or dispute arising between a Job Seeker and a third party (such as a Hiring Company).
Except where the Company has acted with intent or gross negligence, any liability of the Company for damages is limited to direct and ordinary damage actually incurred.
Article 13 (Exclusion of Organised Crime Groups)
Job Seekers represent and warrant that they do not fall within, and are not involved with, organised crime groups. If a breach comes to light, the Company will refuse use of the Service.
Article 14 (Severability)
Even if part of these Terms is held invalid or unenforceable, the remaining parts remain in full force and effect.
Article 15 (Survival)
Article 5, Articles 6 through 8, Articles 9 through 12 and Articles 14 through 16 survive the termination of the Service.
Article 16 (Governing Law and Jurisdiction)
These Terms are governed by the laws of Japan, and the Tokyo District Court or the Tokyo Summary Court shall be the exclusive court of first instance by agreement for any dispute.
